Proposed changes to Probate Administrative Order 6.102


Consistent with Main Branch and North Branch Probate, UMC/Ex-parte days, EFFECTIVE SEPTEMBER 03, 2013, EX-PARTE will be held 2 days per week, Tuesdays & Thursdays 8:45-9:30. UMC will be held  Tuesdays, Wednesdays & Thursdays.

ATTENTION ATTORNEYS:  Administrative Order 2.310-10/12 creates an Online Registration System to assist with Eservice and Online Scheduling by participating judicial divisions.

Due to budget cuts issued by the Florida Legislature during the 2012 session, effective July 2, 2012, the Clerk & Comptroller’s office will be open to the public from 9 a.m. to 4 p.m. Monday through Friday, instead of 8 a.m. to 5 p.m. It is the Clerk’s responsibility to process court documents and prepare court files; therefore, due to the change in the Clerk’s hours in South County, Judge Colin, Judge Martz and Judge Scher have altered the manner in which new cases are to be opened. Ex parte hours will remain the same. However, effective immediately, new cases can no longer be opened the morning of exparte for appearance the same day - NO EXEMPTIONS. New cases must be opened no later than 4:00 p.m. the day prior to the hearing. Proof of the prior filing must be presented at time of hearing before the matter will be heard. Attorney’s need to start preparing the Final Disposition forms; however, they are  being sent in blank.  No file number and no estate name.  They are now responsible for filing these with the orders closing the estate, and they need to be filled out just like any other pleading.
Effective immediately, a self-addressed stamped envelope must accompany all request for certified copies.  If you are requesting conformed copies as well as certified copies, you must supply two (2) self-addressed stamped envelopes. Certified copies will not be send out without a self-addressed stamped envelope.  If only(1) one envelop is received it will be used for your conformed copies.
For the past three  (3) months the Clerk’s office have sent notices to attorneys who did not provide envelopes for their copies. The time has come for the implementation and we are inundated with phone calls inquiring about copies.  We are sorry for any inconveniences caused but we cannot make any exceptions.  Thank you very much for your assistance.

Effective February 2, 2009, all files needed for UMC hearings in Division IY, for Probate, Guardianship, and Mental Health Cases, may be requested ONLINE. We hope this will reduce effort, stress, confusion, and frustration for everyone involved, with files efficiently made available for use at UMC hearings.
Go to: and follow the instructions to request your Probate, Guardianship, or Mental Health files for UMC hearings. It is easy, fast, fun, and so 21st century. As always, you MUST REQUEST THE FILE BEFORE 2:00 PM ON THE BUSINESS DAY PRIOR TO THE SELECTED UMC DATE.  After requesting your file, you can print a receipt to verify the request.
